BUSINESS ENTERPRISES AT UNIVERSITY OF PRETORIA (PTY) LTD (BE at UP)

General Terms and Conditions of www.be.up.co.za
  1. This website located at the domain name www.be.up.co.za  and the information provided therein is provided by Business Enterprises at University of Pretoria (Pty) Ltd (Registration number 1998/025347/07). (hereinafter referred to as the "Provider").
  2. By accessing this website the user accepts to be bound by and to at all times adhere to all the terms and conditions set out hereinafter as well as any other applicable terms and conditions established by the Provider individually ("General Terms and Conditions"). 
  3. When accessing this website the user may download, view and print the content of this website for private and non-commercial purposes only. The user may also use this website to enter into transactions with the Provider, but may never:
    • redistribute, modify, adapt or vary any of the content of this website; 
    • remove any copyright or trade mark notices from any copies of the content of this website;

The user hereby indemnifies the Provider for any and all liabilities, claims, losses and demands of whatsoever nature the user may incur as a result of accessing this website and / or the content hereof or the inability to access the website and / or the content hereof.
  6. The Provider reserves the right to at any time terminate this website, a user's access to or the use of this website and / or to issue summons against a user for any damages suffered by the Provider in any manner whatsoever as a result of such user accessing and / or using this website.
  7. All disputes relating to the use of this website will be referred to arbitration in terms of the Arbitration Act, No 42 of 1965, as amended from time to time and such arbitration shall be held in Pretoria.

The website and all the related pages including but not limited to the content, software, coding, graphics, designs or other material contained in or electronically distributed on this website is owned by the Provider or licensed to the Provider and are protected by local and other legislations. Any unauthorised use whatsoever is strictly prohibited.

  16. The user expressly agrees that the use of this website is entirely at the user's own risk. Neither the user nor the Provider shall be able to institute a claim for consequential damages and the rights to claim consequential damages are hereby expressly waived.
  17. This website is hosted, controlled and operated from the Republic of South Africa and will be governed by the South African law.
  18. The Provider reserves the right to at any time in its sole discretion change, modify, add to or remove from portions or the whole of the General Terms and Conditions. Such changes will become effective upon being posted onto the website. However, it is the user's responsibility to at all times peruse the General Terms and Conditions.
  19. In the event that any of the General Terms and Conditions are found to be invalid, unlawful or unenforceable, such terms will be severable from the remaining terms, which will continue to be valid and enforceable.
  20. No waiver on the part of the Provider of any rights arising from a breach of any of the General Terms and Conditions will constitute a waiver of rights in respect of any subsequent breach of the same or any other provision.
  21. The Provider choose Room 4-23, Administration Building, University of Pretoria, Lynwood Road, Pretoria as its domicilium citandi et executandi.
  22. The Provider makes use of a secure payment system provided and managed solely by MWeb Business (www.mwebbusiness.co.za).
  23. The user may cancel a transaction entered into with the Provider on the website within 7 days after receipt of the goods and / or the conclusion of the transaction, subject to the conditions set out in the Electronic Communications and Transactions Act.
